Publix Super Market Sued After 11-Year-Old Has Convulsions And Dies Eating A Chocolate Cookie

Publix Super Market is being sued after an 11-year-old boy with a nut allergy died eating a "Chocolate Chew" cookie from a Clarksville, TN store.

According to USA Today, the mother of the boy said there were no signs of food allergens at the bakery department and she asked the associate if the cookie contained any nuts. The associate said it didn't. Even then, the mother said she bit into the cookie and didn't find any nuts. Once it got to the kid, however, his mouth started burning three bites in. Sure enough, after breaking apart the cookie, there were walnuts hidden in it.

The parents gave the boy Benadryl, but it didn't help. They then administered an epinephrine pen to his thigh and called 911 as the boy began convulsing and passed out.

They rushed him to Gateway Medical Center before being helicoptered to Vanderbilt University Medical Center, but despite the doctors' attempts to resuscitate him, he didn't make it and was pronounced dead at 10:19 p.m.

The incident occurred on June 3, 2014 when the family was in town visiting the boy's grandma.

Publix did issue a statement saying they were very sorry for the family's loss, but could not comment any further due to the ongoing case.
